Terms of Service

The agreement between AI Driven Marketing and businesses using our services.

The service

We provide an AI receptionist that answers calls forwarded from your business number, collects caller details, and sends those details to you. Depending on your plan it may also book appointments and answer questions about your business.

We also build websites, quoted separately.

Plans and billing

PlanMonthlyMinutes included
Starter$99200
Professional$199500
Business$3991,500

Minutes beyond your plan are billed at 25 cents each. Billing is monthly in advance. Monthly plans have no minimum term — cancel any time and you will not be billed again.

If you pay for a year up front, the setup fee is waived. Annual payments are not refundable on a pro-rata basis unless we fail to provide the service.

Setup

There is a one-time setup fee of $299, which covers configuring your receptionist, loading your business information, testing it with you, and helping you set up call forwarding.

Setup usually takes about a week from the point we have the information we need from you.

What you are responsible for

  • Giving us accurate information about your business, and telling us when it changes
  • Setting up call forwarding on your own phone line
  • Reviewing and approving what your receptionist has been told before it goes live
  • Having a privacy policy of your own that tells your customers their calls may be answered by an automated assistant and transcribed
  • Following up on the leads we send you — we capture them, you close them

What the receptionist will not do

By default, and unless you specifically instruct otherwise, the receptionist will not:

  • Quote a price
  • Promise an arrival time
  • Claim to be a human being if asked directly
  • Attempt to resolve a complaint or argue with a caller
  • Handle an emergency alone — it captures the details fast and alerts you immediately

You can change any of these, and if you do, the consequences of that change are yours. If you authorise price quoting and it quotes a price you did not want honoured, that is between you and your customer.

The receptionist is not an emergency service. It is not a substitute for calling 911, and it should not be the only way anyone reaches you in a genuine emergency.

Acceptable use

You may not use the service to make unsolicited sales calls, to mislead callers about who they are speaking to, or for anything unlawful. We will end the agreement immediately if you do.

Ending the agreement

You can cancel at any time. Tell us and we will switch the receptionist off; calls go straight back to you with nothing else to do.

We may end the agreement with 30 days' notice, or immediately if you breach these terms or do not pay.

Either way, your call records and lead history are deleted automatically 90 days after your account closes. If you want a copy, ask us before then and we will send you an export.

Call transcripts are deleted sooner, on your account's retention setting: 90 days unless you ask us to change it, anywhere from 7 to 365 days.

Liability

The receptionist is software and it will sometimes get things wrong. It may mishear a name, misunderstand a request, or fail to capture a detail. You should treat the leads it sends you as a good starting point, not a verified record.

We are not liable for business you lose through a missed, mishandled or misrecorded call, and our total liability is limited to what you paid us in the preceding three months.

Governing law

These terms are governed by the laws of the State of California, and any dispute will be handled in the courts of Nevada County, California.
